Villa les Terrasses
This document sets out the conditions that governs the rental of “Villa les Terrasses”, booked through our website and whose precise location is contained in the booking confirmation as well as the specifications associated with it (the “Premises”).
§1 Rent and rental period
The Premises are rented for the period stipulated in the booking confirmation (the “Rental Period”). The rental begins at 16h00 on the Arrival Date and ends at 10h00 on the Departure Date. The rent for Rental Period is stipulated in the booking confirmation (the “Rent”).
§2 Number of people/use
The holiday accommodation may not be used for residence by more than 10 people, which also includes children. Two of the beds are likely only suitable for children between 4 and 12 years of age.
§3 Pets
Pets are not allowed.
§4 Cleaning and rental of bedlinen. Tourist taxes.
The Tenant(s) is (are) obliged to keep the Premises clean and must surrender them in a tidy state at the end of the Rental Period. For any rental longer than 3 three days, a final cleaning is mandatory. The charges are EUR 100 which will be paid directly to the cleaner.
Tenants are expected to bring their own bedlinen, bath towels and beach towels. There is a possibility to rent these items.
Tourist taxes (taxe de séjour) are liable to the local municipality. These taxes are charged by the owner, paid together with the Rent and directed to the municipality.
§5 Liability
The Tenant(s) shall be responsible for everything found in the Premises during the Rental Period. In the event of damage, the Tenant(s) shall be obliged to notify the Owner as such immediately. Damage not notified before departure shall be repaired for the Tenant(s)’ account. Damage occurring during the Rental Period shall be repaired as soon as possible, and items must be replaced before departure. The Owner has not taken out any insurance to cover the Tenant’s person or property during the Rental Period.
§6 Terms of payment
Upon reception of the booking confirmation, 50% of the Rent including cleaning charges (the “Advance”) shall be payable within 5 banking days. This payment constitutes the Tenant’s consent to the Rental and to the terms stated in this document. In the event the Advance is not paid within the stipulated period, the Owner is entitled to annul the Rental without further warning.
The balance must be received by the Owner 30 days prior to the start of the rental period.
In the event that the accommodation is ordered less than 30 days prior to the start of the Rental Period, the full amount shall be payable within 5 business days of the booking.
In the event the full rent is not paid on time, the Owner shall be entitled to annul the Agreement without warning.
Payments should be made in one of the ways stipulated in the booking confirmation.
All prices are including electricity, heating, water, additional equipment, etc. In case of excessive use, an additional charge may be added to cover the costs.
§7 Security deposit
The Owners shall be entitled to charge a security deposit for payment together with the 2nd instalment of the Rent. This deposit, which shall serve as security for fulfilment of the Tenant’s obligations, shall be returned 2 weeks after departure, at the latest once a check of the Premises has been carried out to the Owner’s satisfaction.
§8 Complaints
Should there, contrary to expectation, be any complaints in connection with the holiday accommodation that has been rented, please notify the Owner as such, possibly in writing or by e-mail, 48 hours after occupation, at the latest. In the event of complaints related to the standard of cleaning, the Owner must be notified immediately upon occupation. Otherwise, the Tenant(s) shall be held liable for any faults or defects, cf. §5
§9 Keys
The Tenant(s) will receive instruction on how to gain access to the Premises in due time before the start of the Rental Period. The Tenant(s) is (are) obliged to leave the keys as found at the end of the Rental Period. More keys are available at the Premises, giving access to the two bedrooms on the lower level as well as to the main level. This set of keys must be left upon departure.
§10 Cancellation
In the event that the Agreement is cancelled more than 30 days prior to the start of the Rental Period, the Advance will be kept by the Owner. Cancellation after this time shall give rise to payment of the full Rent, 100%.
§11 Cancellation due to illness / insurance
The Owner recommends that the Tenant(s) purchase holiday accommodation rental insurance, or at least cancellation insurance without an excess to cover unanticipated illness.
§12 Force majeure
The Agreement may be terminated by the Owner and the Tenant(s), without notice, as a result of force majeure, strikes, epidemic illnesses, including pandemics, travel restrictions or the like. In the event of termination due to force majeure, strikes, epidemic illnesses, including pandemics, travel restrictions or the like occurring less than 30 days before the first day of the Rental Period, the Agreement shall become null and void and the obligations under this Agreement, including §§ 1, 6 and 7 shall not be binding on the Tenant(s) or the Owner with the exception of the right of the Owner to receive an amount corresponding to the rental for one night to cover third party expenses incurred by the owner related to the cancellation.
If any of the events mentioned before occurs more than 30 days before the first day of the Rental Period, it is incumbent on the Tenant to cancel in a regular fashion. The Owner will in such cases return the Advance already or keep it as guarantee for a later rental as agreed with the Tenant(s). The Tenant(s) cannot claim compensations for other expenses such as pre-paid travel arrangements.
§13 Local court
Any disputes between the Owner and the Tenant(s) shall be brought before the Tribunal de la Ville de Luxembourg, which shall be the agreed local court.
